Alaska

Arizona
Legal with a minimum age of 18 under the Arizona Kratom Consumer Protection Act (KCPA).
Arkansas
Arkansas banned the sale and possession of kratom statewide. The legislature listed as a Schedule I controlled substance, so you can’t purchase it legally, regardless of your age.
California
No statewide age restriction. Legal in most areas but banned in cities like San Diego and Oceanside. Bills have been introduced to set a minimum age but have not been passed.
Colorado
Statewide age restriction of 21+ took effect in July of 2024. Additional local bans exist for all ages in some CO cities, like Parker and Monument.
Connecticut
No age limit yet. Connecticut legislators have proposed regulating the age to buy kratom, but no laws have been enacted.
Delaware
Legal and unregulated. No age-related legislation passed.
Florida
Legal with a minimum age of 21 under the 2023 Florida Kratom Consumer Protection Act. Applies to both retail and kava bars.
Georgia
Legal for individuals 21+. The kratom age limit in Georgia was previously 18+, but it was increased in 2025.
Hawaii
Legal and unregulated at the state level. Multiple failed attempts to restrict or schedule kratom.
Idaho
Legal. No state-level age restriction. Previous regulation bills have not passed.
Illinois
Legal with an 18+ age limit. Local bans exist in multiple cities (e.g., Jerseyville, Alton, Glen Carbon, Maryville, Edwardsville, and Wood River). Giving kratom products to minors or kratom possession by minors in IL is a misdemeanor.
Indiana
Kratom is not legal in Indiana. Both mitragynine and 7-hydroxymitragynine are scheduled.
Iowa
Legal and unregulated. No minimum age law.
Kansas
Legal. No age restriction in effect. Regulation efforts are ongoing.
Kentucky
Kentucky enacted a kratom law in 2024 to restrict anyone under age 21 from buying kratom (effective mid-2024).
Louisiana
Made all kratom sales illegal regardless of age in 2025. (Prior to the ban, kratom was available for anyone over 21 years old)
Maine
Legal and unregulated. No age limit. Kratom was excluded from a 2017 bill that could have banned it.
Maryland
Minimum age to buy kratom in Maryland is 21 years old. The legislature passed the Maryland Kratom Consumer Protection Act in 2024.
Massachusetts
Legal. No current age restriction, but past bills attempted to set age limits. Sale is illegal in some cities for all ages (e.g. Lowell).
Michigan
Not yet regulated. Multiple proposed regulation bills have failed.
Minnesota
Legal with an 18+ age limit. Sale to minors is a gross misdemeanor; possession by minors is a misdemeanor.
Mississippi
You have to be 21+ to buy kratom in Mississippi. Kratom is also banned for all ages in numerous towns and counties.
Missouri
Legal. No legal minimum age requirement.
Montana
Legal and unregulated. Ban attempts have failed thus far.
Nebraska
Not yet regulated. A 2024 bill to ban kratom failed to advance.
Nevada
Legal for adults 18+ under Nevada Assembly Bill 303 (2019).
New Hampshire
Legal and unregulated at the state level. Banned in the city of Franklin. No confirmed state age limit.
New Jersey
Legal and not yet regulated.
New Mexico
Legal with no state-level age restrictions.
New York
Passed SB S4552A in December of 2025 to prohibit the sale of kratom to anyone under the age of 21.
North Carolina
Legal. No confirmed state-level age limit. A bill introduced in 2025, H467, would create a 21+ age limit if passed.
North Dakota
No age minimum. Legal and unregulated.
Ohio
An emergency rule made certain derivatives of kratom alkaloids illegal as of December 2025, but no laws have been passed through the legislature yet.
Oklahoma
Legal with an 18+ age minimum. Regulated under the Oklahoma Kratom Consumer Protection Act, which was amended in 2024.
Oregon
Legal for individuals 21+. Law passed without criminal penalties for underage possession. Sale to minors in OR is a class C misdemeanor.
Pennsylvania
Legal. No official age restriction, though a 21+ bill was proposed in 2023.
Rhode Island
Rhode Island set the age limit to buy kratom at 21+. (Kratom was a controlled substance in Rhode Island until the passage of the Rhode Island Kratom Act in 2025.)
South Carolina
South Carolina Kratom Consumer Protection Act passed in 2025 sets the minimum age to buy kratom at 21 years old.
South Dakota
Legal with a minimum age of 21. Possession by minors is a misdemeanor.
Tennessee
Buying kratom is legal for individuals 21+.
Texas
Legal for individuals 18+. Regulated under the Texas Kratom Consumer Health and Safety Protection Act.
Utah
Legal with an 18+ age limit.
Vermont

Unfortunately, there isn’t a standard minimum age to buy kratom online or in stores in the United States.
